This case was pending for quite some time due to the personal bankruptcy of one of the individual defendants. The claim alleged was that AmVets defamed Higgins Lake Board Members when they were suspended after inappropriately opening up a checking account. The three plaintiffs were disciplined, given their opportunity for a hearing, but chose litigation. The plaintiffs agreed they did not have a viable defamation claim and the Judge ruled that the conduct did not rise to the extreme level. Plaintiff’s initial demand was $300,000; original counsel withdrew due to health issues. New counsel’s demand was $60,000. Case was dismissed upon motion for summary disposition.
