No Fault First Party Personal Injury Protection Benefits

Motor Vehicle Litigation / September 10, 2014

Court/Case No: Wayne County Circuit Court/13-000576-NF

Tried/Argued Before: Jury

Demand:  $112,000 plus costs

Verdict:

Name of Judge(s): Hon. Patricia Fresard

Keys to the Case:

The jury determined that Plaintiff did not sustain any injury in the subject motor vehicle accident.  This was in spite of the fact that Plaintiff had two post accident right shoulder surgeries, one breast implant removal and reconstruction procedure, a planned left shoulder replacement surgery, extensive physical therapy, other medical bills, wage loss, replacement services, and ongoing attendant care.  It was also in spite of the fact that the carrier paid approximately $180,000.00 to or on behalf of Plaintiff for no fault benefits before benefits were terminated.  The jury did not believe that Plaintiff’s pre-existing medical conditions were aggravated by the collision.
