Tee’d Up: Michigan Supreme Court Hears Oral Arguments on Whether Golf Cart Accident is Inherent Risk for Co-Participants in a Round of Golf

In Bertin, the trial court applied the Ritchie-Gamester standard of reckless misconduct to co-participants in a round of golf where both parties had consented to the use of a golf cart as part of the game, and the Plaintiff was injured when he was struck by the golf cart driven by the Defendant. The Court of Appeals reversed the decision & determined that a golf cart accident is not an inherent risk in the game of golf. The Defendant appealed. The Michigan Supreme Court. heard oral argument on 4-25-18. The Michigan Supreme Court. will issue a decision in the coming months.
