For more than a quarter century, our firm has defended the interests of drug and device manufacturers and sellers in a variety of liability actions. We are also recognized as leaders in defending pharmacies from lawsuits alleging pharmacy malpractice and false advertising. Our experience includes participation in multi-district litigation, class actions, state actions, and federal actions. Secrest Wardle has served as national coordinating counsel for mass tort claims pertaining to allegedly defective generic medications.

Our Drug and Medical Device Practice Group has defended claims involving many products, including the following:

Antibiotics

Anticonvulsants

Bendectin

Diet drugs

Ephedra

Felbatrol

Generic medications

Heart valves

Oral contraceptives

Vaccines

Ventilators

Pacemakers

Over-the-counter medications

FDA-approved food supplements

Secrest Wardle has played a seminal, leadership role in helping to define Michigan law on proximate cause and the learned intermediary doctrine. Most recently, we have taken the lead in affirming the constitutionality of tort reform as it pertains to pharmaceutical manufacturers and sellers (Taylor, MCL 600, 2946 (5)).

We have served as national coordinating counsel for claims, subsequent to product recall, involving a generic preparation of carbamazepine. Secrest Wardle served as lead Michigan counsel in the diet drug (FenPhen) litigation.
