PIP/Uninsured Motorist
Motor Vehicle Litigation / June 21, 2016
Court/Case No: Michigan Court of Appeals Case No. 326109
Tried/Argued Before: Michigan Court of Appeals
Demand: $150,000.00
Verdict: $0 - Summary disposition granted on appeal, reversing the trial court
Name of Judge(s): Honorable William B. Murphy, Honorable Henry William Saad, and Honorable Stephen L. Borrello
Keys to the Case:
Years of experience dealing with UM/UIM coverages – coupled with exhaustive legal research, concise briefing, and thorough preparation for appellate oral argument – enabled Sentinel’s appellate counsel to persuade a three-judge panel of the Court of Appeals to apply Sentinel’s UIM policy exclusion for “any claim settled without our consent.” Plaintiff and the underlying tortfeasor mutually accepted case evaluation without seeking Sentinel’s approval, yet the trial court refused to apply the exclusion. The Court of Appeals reversed, holding that Sentinel has no exposure for UIM benefits as a matter of law.
