This case arose out of a motor vehicle accident that occurred on August 12, 2019, in Clinton Township. Plaintiff alleged that his car was sideswiped by a truck driven by Defendant. The testimony of Plaintiff established that prior to the accident, Plaintiff was at the intersection, stopped at a stop sign. Defendant was driving a semi-tractor trailer loaded with freight, on westbound Cass Avenue.  Plaintiff testified that he pulled out onto Cass and Defendant “cut him off,” causing the collision. However, little did Plaintiff know that the truck was equipped with a dash cam. The dash cam video conclusively demonstrated that Defendant did not cut off Plaintiff’s vehicle, but was at least half-way through a lane change from the left to right lane of westbound Cass Avenue when the cab of his vehicle passed Little Road where Plaintiff was waiting to turn onto westbound Cass. Judge Edward Servitto granted Defendant’s MSD based on no negligence without oral argument.
