This was a joint third-party auto negligence case involving a woman and her adult daughter, both of whom were involved in a motor vehicle accident. Plaintiff Amber Westerman alleged she sustained a threshold injury, despite missing little to no work. Additionally, the bulk of her treatment consisted of chiropractic manipulations for approximately two months. Plaintiff had three visits with Mendelson Kornblum; eventually, MRIs performed six months after the accident noted only degenerative changes. Ms. Westerman worked full time without any restrictions, continued to volunteer is a sports booster with her son’s school, and was not restricted from any activities by any physician. Judge Murphy granted the Motion for Summary Disposition.

Two days later, Judge Murphy granted Defendant’s Motion to Dismiss for Violation of Court Order with respect to claims filed by Darlene Westerman as well. Both Plaintiffs’ claims are now dismissed with prejudice.
