Have an Ice Day: COA Affirms Plaintiff Verdict in Concession Cart Injury at Joe Louis Arena

In Schmunk, the Michigan Court of Appeals confirmed a jury award of nearly $250,000 against Olympia Entertainment, Inc., the concessions provider at the Joe Louis Arena, for injuries claimed as a result of a patron tripping over a cart pushed by an employee at the arena. The Court distinguished a premises action as opposed to general negligence as the claim arose from the conduct of an employee, rather than from a claimed defect in the actual property itself.
