Areas of Focus

Anthony Randazzo has provided exceptional legal expertise in representing a variety of commercial clients involving commercial disputes for nearly 18 years.  Throughout that time, Mr. Randazzo has successfully litigated commercial matters including, but not limited to, claims for breach of contract, breach of non-compete agreements, breach of non-solicitation agreements, misappropriation of trade secrets, breach of fiduciary duties, tortious interference with business expectancy, and tortious interference with contractual relationship. Notable cases that highlight Mr. Randazzo’s commercial and business law experience are set forth below.

In 2008, he successfully defended a commercial client in a case where Plaintiff sought monetary damages in excess of $185,000.00 for claims based on breach of contract, fraud, and conversion of property. After a four-day trial, Plaintiff received a verdict in the amount of $22,000.00. However, after a six-hour post-judgment hearing, and a successful appeal, Mr. Randazzo successfully argued that his client was entitled to case evaluation sanctions in the amount of $218,000.00, thereby producing a net judgment in favor of his client in the amount of $196,000.00.

Mr. Randazzo’s commercial litigation success is also exemplified by his representation in a case entitled Singh v Town & Country, et al. In that case, Mr. Randazzo filed a complaint on behalf of his client to recover damages resulting from a breach of a commercial lease agreement. After focused discovery was performed, Mr. Randazzo obtained a $4.3 million judgment for his client. An article about this case was featured in Michigan Lawyers Weekly as one of the top judgments in 2009.

In 2013, Mr. Randazzo secured an $815,000.00 settlement on behalf of his client in a commercial matter that was filed in Oakland County Circuit Court. The lawsuit included, among other things, claims for tortious interference with contractual relationship, tortious interference with business expectancy, misappropriation of trades secrets, and breach of contract. While the defendants denied liability throughout the litigation, Mr. Randazzo’s aggressive discovery enabled him to secure liability admissions that led to a very favorable resolution for his client. The name of the case has been omitted here because the settlement was confidential.

In 2018, Mr. Randazzo successfully defended a breach of contract matter in Oakland County Circuit, before the Honorable Wendy Potts. The lawsuit arose out the sale and purchase of a home remodeling company. Plaintiff sought damages close to $1,000,000.00.  However, after executing an aggressive discovery plan, Mr. Randazzo was able to secure a positive resolution for his client, which resulted in a settlement payment to his client and a dismissal of the action. The name of the case has been omitted here because the settlement was confidential.

In addition to litigating commercial disputes, Mr. Randazzo routinely assists his commercial clients in developing various contracts to help protect their business interests including non-disclosure, non-solicitation, and non-compete agreements.

Anthony A. Randazzo has defended clients in a variety of environmental and toxic tort cases, ranging from leaking underground storage tank cases to air pollution cases. He has also represented environmental clients in mass tort and class action lawsuits involving several hundred plaintiffs. Mr. Randazzo’s knowledge of environmental law has enabled him to successfully defend clients in these actions.

One of Mr. Randazzo’s more notable environmental cases involved a matter entitled Penn v BP North America, et al. In that case, Plaintiffs alleged that BP owned and operated leaking underground storage tanks, which purportedly caused more than $20 million in damages to Plaintiffs’ business. However, after focused discovery was performed, Mr. Randazzo successfully argued a Motion for Summary Judgment, which dismissed all claims against BP with prejudice.

Snowden v Artisan Tile, Inc., et al is another notable environmental case that Mr. Randazzo successfully litigated. In that matter, Plaintiff sought damages in excess of $4 million due to alleged chemical exposure. However, after pointed discovery, Mr. Randazzo was able to secure an order dismissing the lawsuit with prejudice.

One of Mr. Randazzo’s more notable intellectual property/advertising injury cases involved a claim that his client infringed on a copyrighted home plan. Mr. Randazzo’s client was a local homebuilder. The Plaintiff is a company that licenses home plan designs. Plaintiff claimed in excess of $30 million in damages. Mr. Randazzo developed a thoughtful defense strategy which he implemented during the discovery process. As a result, Mr. Randazzo was able to obtain very favorable admissions by Plaintiff that eventually led to a dismissal of the lawsuit with prejudice.   It is worth noting that Mr. Randazzo never paid any amount of money to the Plaintiff. The name of the case has been omitted here due to a confidential settlement agreement.

Mr. Randazzo’s expertise in this area of the law has allowed him to successfully resolve cases in favor of the Firm’s clients for nearly 18 years. A few of Mr. Randazzo’s recent notable motor vehicle litigation successes are listed below.

In 2017, Mr. Randazzo successfully litigated an automobile/tractor-trailer accident in Clinton County, Michigan. In that case, Plaintiff claimed that the Defendant semi-truck driver swerved into her lane causing her to lose control of her vehicle and violently strike the side of the semi-truck. Plaintiff claimed various personal injuries, including multiple herniated discs in her cervical and lumbar spines. Mr. Randazzo deposed Plaintiff in excess of seven hours. During that time, Mr. Randazzo was able to secure admissions from the Plaintiff that she had no factual basis to suggest that Defendant truck driver was negligent. Similarly, Mr. Randazzo obtained admissions to support a conclusion that Plaintiff’s injuries were not proximately caused from the subject accident. Following the deposition, Mr. Randazzo successfully argued a Motion for Summary Disposition resulting in a complete dismissal of the case with prejudice.

More recently, Mr. Randazzo litigated an automobile/tractor-trailer accident that occurred on I-69 in Imlay City, Michigan. The case was entitled Alfredo Garcia et al. v TTR Transport Fleet et al., and was pending before the Honorable Stephen J. Murphy, III, in United States District Court, Eastern District of Michigan. Plaintiff was an unrestrained front passenger in a vehicle driven by Plaintiff’s brother (a co-worker). Just prior to the accident, Plaintiff and his brother were painting an overpass at M-53 and I-69, in Imlay City, Michigan. At lunchtime, Plaintiff and his brother decided to go to a nearby fast-food restaurant. The accident occurred when Plaintiff’s brother reversed from the construction zone (the median portion between east and westbound I-69) into oncoming traffic. As a result of the accident, Plaintiff sustained life-threatening injuries. The jury verdict potential for this case well exceeded $15 million. Mr. Randazzo deposed in excess of 15 lay witnesses, who all supported the fact that Mr. Randazzo’s client was not negligent and did not cause the accident involving Plaintiff. Mr. Randazzo was also able to secure admissions from employees for three non-parties at fault which further exculpated Mr. Randazzo’s client. The aggressive discovery led to a resolution for the paltry sum of $35,000.00, well before the conclusion of discovery and before any experts had been deposed.
