Areas of Focus

Justin Grimske is a Senior Partner at Secrest Wardle’s Troy location. Mr. Grimske joined the Firm in 2012 and is a member of the Amusement and Leisure, Construction, General Negligence, Motor Vehicle Litigation, Premises Liability, and Trucking/Commercial Vehicle Litigation Practice Groups. He also proudly serves as Chair of the Firm’s Amusement and Leisure Practice Group, a group that has been instrumental in the development of amusement and leisure case law in Michigan.

 

Mr. Grimske possesses experience in defending clients in a variety of premises liability and amusement and leisure settings.  In the past, Mr. Grimske has successfully defended entertainment entities, including hockey rinks, and gymnastics studios, amongst others. Most recently, Mr. Grimske, and another Secrest Wardle attorney, obtained a favorable defense verdict in a premises liability action wherein Plaintiff sustained significant injuries to his leg and ankle.

 

Mr. Grimske is a member of the International Amusement and Leisure Defense Association (IALDA), a non-profit association of lawyers and other professionals who are actively engaged in representing the interests of the amusement and leisure industries. He is also a member of the International Association of Amusement Parks and Attractions (IAAPA), an organization serving its membership by promoting safe operations, global development, professional growth and commercial success of the amusement parks and attractions industry. Mr. Grimske frequently serves as a speaker at seminars providing updates and other pertinent information to clients and others in the legal industry. He earned his B.S. from Arizona State University in 2010, majoring in Business (cum laude). While pursuing his undergraduate degree, Mr. Grimske served as the Engineered Leadership chair for the Delta Sigma Phi Fraternity – Beta Psi Chapter. He earned his Juris Doctor from the University of Detroit Mercy School of Law in 2013.

 

While in law school, Mr. Grimske served as an intern for the Michigan Supreme Court. Mr. Grimske also served as an intern to the Honorable David Groner, during his time at the Frank Murphy Hall of Justice. As part of that internship, Mr. Grimske worked hands on with Judge Groner in the sentencing of former Detroit mayor, Kwame Kilpatrick.

In 2013, he was also recognized by Who’s Who Among Students in American Universities & Colleges as an up and coming lawyer.

 

Mr. Grimske has been admitted to the Michigan Bar since November 2013 and is currently admitted to practice in the United States District Court, Eastern District of Michigan.

Notable Cases:

    • In a first-party (PIP) matter, Mr. Grimske was successful in arguing a Motion for Summary Disposition regarding the issue of Plaintiff not providing notice of specific injury within one year of the motor vehicle accident as outlined in MCL 500.3145.  Plaintiff’s demand was $100,000.00.  Motion was argued in front of Judge David J. Allen of Wayne County Circuit Court.

 

  • In a first-party (PIP) matter, Mr. Grimske was successful in arguing a Motion for Summary Disposition regarding the issue as to whether or not a parked motorhome was being used in the transportation function, even though it had been parked for several hours. The success of the motion effectively saved Progressive $145,000.00. Motion was argued in front of Judge Michael Mack of Montmorency Circuit Court.
  • In a first-party (PIP) matter, Mr. Grimske was successful in arguing a Motion for Summary Disposition with respect to Bahri v IDS Prop Cas Ins Co., and surveillance portraying Plaintiff unloading a refrigerator into his van unassisted. Motion was argued in front of Judge James M. Biernat, Sr. of the Macomb County Circuit Court. Matter case evaluated for $135,000.00.
  • In a first-party (PIP) matter, Mr. Grimske was successful in arguing a Motion for Summary Disposition with respect to the Assigned Claims Facility’s right for reimbursement against GEICO being time-barred pursuant to MCL 500.3175(3), no notice from the insured to the insurance company and breach of a condition precedent to coverage. Motion was argued in front of the Honorable Leslie Kim Smith of the Wayne County Circuit Court.
  • In 2017, Mr. Grimske defended an insurance company against a suit filed by a provider in Oakland County Circuit Court alleging outstanding medical bills on behalf of the underlying claimant in the amount of $96,236.00. The Plaintiff claimed entitlement to no-fault benefits alleging that the underlying claimant was a resident relative of the insurance company’s named insured in West Bloomfield, Michigan. Defendant then proceeded with a Motion for Summary Disposition based on: (1) Plaintiff failed to provide any independent verification of loss and thus failed to prove the fact of the loss as required by Michigan No-Fault; (2) Plaintiff was judicially estopped from the position that she was a resident relative of the insurance company’s insured in West Bloomfield, as the underlying claimant admitted that she was a resident of Wayne County at the time of loss. Following oral argument, their motion was granted based on judicial estoppel. Plaintiff subsequently filed a Motion for Reconsideration, which was denied by the court.

Mr. Grimske possesses experience in defending clients including property owners, contractors and subcontractors. Recently, in April of 2019, Mr. Grimske obtained a No Cause verdict as solo trial counsel in a premises liability/ordinary negligence cause of action that arose from an alleged slip and fall in a parking lot. Mr. Grimske defended a reputable Macomb County business that contracted to maintain the premises including snow removal and salting. Plaintiff requested $500,000.00 from the jury in her closing arguments. However, following a three-day trial, before Judge Carl Marlinga, which included numerous witnesses and expert testimony, the jury returned a unanimous 8-0 verdict that Defendant was not negligent in performing the contractual duties it had with the premises owner.
