Wrongful Death Act Allows for Recovery of Lost Wages and Earning Capacity Without Expectation of Support

The estate of a decedent “may recover damages for lost wages and earning capacity of their decedents.” Judge David M. Lawson of the Eastern District of Michigan rendered that Opinion and issued an Order denying Defendant FCA US, LLC’s Motion for Partial Summary Judgment regarding Plaintiffs’ economic damages. White v. FCA US, LLC, No. 17-12320 (E.D. Mich. Nov. 19, 2018).
Judge Lawson’s opinion clearly states the Michigan Supreme Court has not settled this issue. Mr. Truex and Mr. Lepola’s article highlights important takeaways from this Opinion.
