At No Cost to You: Trial Court has Discretion to Apportion Taxable Costs Among Parties

Mackenzie, et al. v Home Owners Insurance Company, unpublished opinion per curiam of the Court of Appeals, issued September 19, 2019 (Docket No. 341712) reiterates that after awarding costs to a prevailing party, the trial court has discretion to apportion the costs among the parties as it deems appropriate. This is important to keep in mind when costs are assessed against multiple parties and one, or more, of the parties are insolvent.
