Free Fallin’: Plaintiff’s Lack of Evidence of Causation of Fall Leads to Dismissal

In Gutierrez v Smith, Plaintiff failed to establish the causal nexus necessary for her to pursue claims under either common-law premises liability or MCL 554.139(1)(b) after falling outside of her apartment. The mere presence of a broken step outside of her apartment was insufficient to prove it was responsible for her fall.
