Sword and Shield: Non-Mutual Defensive Use of Collateral Estoppel

Estate of Janet L. Parks v Joe K. Sandy, et al. affirmed that collateral estoppel bars plaintiffs from bringing underinsured motorist claims against insurers when the plaintiff either settled or received a judgment which does not exceed the third-party defendant’s bodily injury limits.
