Find the Fraud, Plead the Fraud, Preserve the Fraud

This unpublished decision further establishes the Court of Appeals’ intent to further chip away at no√¢‚Ǩ‚Äòfault insurers’ ability to obtain summary disposition, even when its insured’s actions were clearly fraudulent. Thus, it is even more imperative that claim files be reviewed thoroughly, and fraud pled with specificity immediately after it is discovered in order to preserve the issue not only for the lawsuit involving the insured but also for any subsequent provider suits that invariably arise.
