Rescission Not Precluded

An insurer is not necessarily precluded from rescinding a policy, even when a notice of non√¢‚Ç¨‚Äòrenewal was issued prior to the rescission. However, the Court noted that the question of whether an insurer is precluded from rescinding the policy after cancellation or non-renewal has been issued will involve whether the insurer induced the insured into believing coverage existed at the time of the accident.
