“Go the Extra Mile: Court of Appeals Holds That the Trial Court Erred in Determining Whether Parties Took Necessary Steps to Transfer Title of Vehicle”

St. John Hospital & Medical Center, et al. v Nationwide Mutual Fire Insurance Company and Home-Owners Insurance Company tells us it is important to properly transfer legal title of a vehicle from one individual to another to avoid run-ins with insurance carriers determining order of priority. To properly effectuate transfer of title, the safest option is to make sure the buyer signs the assignment of title and accompany the buyer to a Secretary of State branch to assure that the title of the vehicle being sold is properly transferred. MCL 257.240. To further ensure that title was properly transferred, the seller should maintain all relevant documentation of the transfer. Not only will these steps ensure that title was transferred, but that the transfer was set in force.
