Hit and Run? Run to the Police! Time Restraint Bars Individual from Recovery of Benefits on UM Claim

The Court of Appeals highlights a distinction between PIP benefits and UM benefits. Uninsured motorist insurance permits an injured motorist to obtain coverage from their own insurance company to the extent that a third-party claim would be permitted against the uninsured at-fault driver. Rory v Continental Ins Co, 473 Mich 457, 465 (2005). An individual may recover for PIP benefits by statute. In order for an individual to seek UM benefits, they must follow the terms of the contract.
