Recreational Land Use Act Trumps Owner’s Liability Claim: Grandfather Immune From Suit After Granddaughter Died While Riding His ATV On His Property

Even though the Recreational Land Use Act (the “RLUA”) and owner’s liability provision of the Motor Vehicle Code both apply to the use of ATVs, the Court of Appeals unanimously held in a published opinion that the immunity afforded by the RLUA trumped the liability imposed by the Motor Vehicle Code because the pointed language of the RLUA applied with greater specificity to the circumstances of the case.
