Plaintiff was a passenger on a transportation bus when the rear side of the bus was struck by Defendant’s work van. However, the impact was minimal and the only damage was broken glass to the van’s passenger mirror. Following the accident, Plaintiff continued to work as a laborer in a factory. He worked nearly a full shift and was sent home for the day due to a lack of work, not because of any accident-related injuries. Plaintiff did not report any of his alleged injuries sustained in the accident until three days later.
During trial, Plaintiff failed to produce any testimony from a medical expert that established he suffered an injury in the accident or that he suffered a threshold injury. As a result, Judge Druzinski granted Defendant’s Motion for Directed Verdict and dismissed the case.
