This is a third-party negligence action alleging Defendant’s driver was negligent in causing injuries to Plaintiff as a result of a motor vehicle accident. Plaintiff was a passenger in a cab owned by Defendant and driven by its employee. The cab was stopped at a red light when it was rear-ended by a vehicle that fled the scene. Plaintiff alleged back and neck injuries resulting in the need for physical therapy, multiple steroid injections and ultimately two lumbar fusion surgeries. Plaintiff alleged a failure to report the accident to the police, failure to assist Plaintiff in obtaining medical attention, negligent hiring and negligent entrustment of the vehicle, as well as negligent operation of the cab.
On July 9, 2018, Judge Toia granted Defendant’s Motion for Summary Disposition finding no genuine issue of fact that neither Defendant nor its driver were the cause of Plaintiff’s injuries.
