Mr. Mitchell has an incredible amount of successful defense experience in the courtroom. Adept at dealing with complex litigation, he has handled numerous significant cases involving hundreds of plaintiffs and millions of dollars, and has successfully obtained favorable verdicts at trial in personal injury, construction site accident, and construction defect cases.
Mr. Mitchell has defended personal injury claims, construction defect claims, property damage claims, and, for all practical purposes, the entire spectrum of claims that can be brought against those involved in construction. His work has also involved litigation over transactional elements, including matters contractually required to be subject to arbitration, addressing problems of cost overruns and enforcement of liens. He has been a frequent presenter at seminars discussing liability theories and defenses with respect to personal injury claims brought against general contractors and construction.
Mr. Mitchell received his Juris Doctor, cum laude, from Wayne State University in 1986. He previously received his Bachelor of Science Degree from Michigan State University in 1977. Mr. Mitchell has an incredible amount of experience successfully defending the pharmaceutical and medical device industries against a range of actions. He is adept at dealing with complex litigation, and has handled numerous cases involving hundreds of plaintiffs and millions of dollars.
Mr. Mitchell served as state-wide lead defense counsel in the diet drug litigation. He was also retained to represent a diet drug manufacturer in mass tort cases throughout the Midwest (including Ohio, Indiana, and Illinois). He has served as regional counsel in the ephedra litigation, representing an ephedra manufacturer for claims in Wisconsin and Michigan. Mr. Mitchell served as national coordination counsel to defend a generic manufacturer of anti-convulsant medication. He has also successfully tried cases to jury verdict for manufacturing issues such as birth defects and claimed impairment to the immune system.

Mr. Mitchell has been an asset to Secrest Wardle since 1986 and is currently serving as Of Counsel. He is a member of the Firm’s Construction, Drug and Medical Device, Environmental and Toxic Tort and Product Liability Practice Groups.

Mr. Mitchell has been involved significantly and essentially from the outset, in claims regarding injury (personal injury and property damage) due to exposure to mold and due to work place exposure to allegedly toxic chemicals, such as metal working fluids. As to the former, he was counsel involved in developing testimony to support Daubert-based motions that there is no credible science to support neurotoxicity claims. As to the latter, he served as managing counsel for mass tort claims involving hundreds of plaintiffs.
Mr. Mitchell has successfully defended cases alleging personal injury and property damage from exposure to ozone generators, inclusive of use of Daubert trials, disposition motions, and successful jury trials.
With respect to his involvement in the Indoor Air Quality Association, and in particular, the Indoor Environmental Standards Organization (IESO), Mr. Mitchell served on the IESO Consensus Body. The Consensus Body oversaw the development of industry standards and, in particular, at that time, it was attempting to set standards as it pertains to indoor air quality for things such as mold, arsenic, and other potential environmental hazards. Previously, Mr. Mitchell was appointed a member of the Writing Group, for the IESO, involved in developing a codified standard for preliminary evaluation and testing of contaminated sites.

Mr. Mitchell served as national coordinating counsel in defense of claims regarding the use of carbamazepine for a generic drug manufacturer. Subsequent to an FDA-ordered recall of the product, he was appointed national counsel to coordinate the defense of all claims brought against the manufacturer of the anti-convulsive medication at issue. He successfully obtained dismissals of some cases, limited the exposure in death cases, and coordinated the action of counsel around the country in the defense of such cases.
