No Liability For Out-Of-Possession Tenant

In Hoffner v Lanctoe, et al, ___ Mich App ___ (issued Nov. 2, 2010) (Docket No. 292275), the Court of Appeals clarified when a tenant could be liable for a dangerous sidewalk, noting that liability attaches only when the tenant has possession and control.
