Falling Chairs: Action Involving Chairs Falling from Shelf is Sounded in Ordinary Negligence

In Thomas v Woodward Detroit CVS, LLC, d/b/a CVS Pharmacy, Mich Ct App Docket No. 331486 (October 24, 2017), Plaintiff was a customer at CVS Pharmacy and asked for assistance with folding chairs located on a top shelf. A CVS employee attempted to manipulate the stack of chairs, causing them to fall from the top shelf and onto Plaintiff’s head. Plaintiff alleged to have sustained a traumatic brain injury as a result of the incident, which caused her to suffer serious cognitive impairment, memory issues, and headaches.
