ID Your Injury: MCL 500.3145(1) Requires Description of Symptoms Traceable to a Diagnosed Injury

In Green v Home-Owners Insurance Company, the Michigan Court of Appeals has applied the recent Supreme Court decision in Dillon v State Farm Mut Auto Ins Co, ___ Mich at ___ (2017) in holding that the PIP claimant’s failure to provide a general description of symptoms that were traceable to the claimed injury within one year of an accident barred recovery for benefits related to that injury. The important takeaway from the case is that now, a claimant must at least report “a description of symptoms that are traceable to a diagnosed injury.”
