The implications of the Michigan Supreme Court’s decision regarding Covenant is significant for no-fault insurers: healthcare providers have no standing to bring an independent action for PIP benefits under the Michigan No-Fault Act. Although it was anticipated that this would be a huge victory for insurers and significantly limit litigation in the no-fault arena, with so many judges ruling differently across the board, the need for clarification from the Supreme Court is highly anticipated.
