What should employers be doing in the wake of Bostock?

Employers should begin by reviewing workplace policies to ensure compliance with the new standard set forth by the Court. This includes updating employee manuals to contain the appropriate language to prohibit discrimination on the basis of sexual orientation and gender identity. Id. The majority opinion written by Justice Gorsuch answered this question in the affirmative holding that an employer who fires an individual merely for being gay or transgender violates Title VII. Id.

 

Employers should consider providing or updating complaint procedures for impacted employees. Supervisors and Human Resource Officials should complete updated training.
