Court of Appeals Holds Financial Records of Retained Experts Potentially Discoverable: Trial Court Must Balance Value for Plaintiff against Burden of Discovery

This is the first published opinion in Michigan to consider the issue of discoverability of a retained expert’s financial information. The Court of Appeals has essentially made this a “case by case” determination, dependent on a balancing of interests, including privacy interests of the expert and the seeking party’s need for the information.
