This premises liability/ordinary negligence cause of action arose from an alleged slip and fall that occurred as Plaintiff was leaving her workplace. Due to the fall, Plaintiff sustained significant injuries to her neck and shoulder that eventually led to surgery. Defendant was a reputable Macomb County business that contracted to maintain the premises including snow removal and salting. Plaintiff’s contention was that Defendant created the black ice on the premises that led to her fall. She argued that the Defendant left a large pile of snow near the premises’ heavily traveled handicap ramp and when that snow subsequently melted it refroze into black ice.
Plaintiff requested $500,000.00 from the jury in her closing arguments. However, following a three-day trial, before Judge Carl Marlinga, which included numerous witnesses and expert testimony, the jury returned a unanimous 8-0 verdict that Defendant was not negligent in performing the contractual duties it had with the premises owner.
